Apple made a bold move to omit the earbuds and power adapter from iPhone 12 package this year. And while it sounds reasonable that the company has every right to include or not to include anything it wants with its phones, things are not that simple.
The São Paulo state in Brazil reportedly announced that the omission of earbuds and charging adapter violated consumer rights, according to Procon-SP – a São Paulo-based public consumer protection agency.

Apple’s Environmental Argument
Apple, explaining its decision not to include a power adapter and earbuds with iPhone 12, said it was a move for the benefits of the environment, due to the reduced e-waste of manufacturing these accessories.
This also means Apple can shrink the size of packages, which in turn reduces shipping cost, and yes, the impact of shipping on the environment. The Cupertino tech giant will probably see a boost in demand for its accessories now that users don’t have them in the same box anymore.
Procon-SP did consider Apple’s claim about the environmental impact but it said the reduction of electronic waste and carbon emissions wasn’t demonstrated properly.
The agency’s report noted that Apple’s move would undergo review and further investigation by a supervisory board. If the conduct is found to be a violation, Apple could face a fine under the Brazilian Consumer Protection and Defense Code.
Apple has gone through similar trouble in France with the omission of the earbuds. So as a result, France is the only nation in the world where iPhone 12 is shipped with EarPods.
