A day after Google’s Chief Executive Officer – Sundar Pichai – being questioned on data privacy during a House hearing, a list of acts has been made with the aim of protecting users' personal information.
The list, also known as the Data Care Act, was proposed by over a dozen of senators, which includes Sen. Brian Schatz (D-HI), Cory Booker (DN-J), and Amy Klobuchar (D-MN). The list was created with the purpose of enforcing new rules on how companies and corporations should be collecting and handling their users' data.
According to the new law, companies and corporations are required to “reasonably secure individual identifying data from unauthorized access.” Moreover, they are required not to mishandle their collected data, and promptly inform their users of any violation concerning their private information if it was to happen.
The senators have also extended the requirement to third parties if any data is sold to another entity by the data collectors, the collectors’ acts will be considered as an act of deceptive towards users’ data and they will be fined by the Federal Trading Commission.
The proposition is amongst a few others, while the Congress searches for the most optimal way to monitor the modern tech industry. Other proposals have suggested include one from Sen. Ron Wyden (D-OR) about putting executives in jail for mishandling users’ data.
Few of privacy activists approve the new law. India McKinney – EFF’s legislative analyst – stated that the association would expect to co-operate with the Senators to further improve the law to strengthen information fiduciary protections which would meet the requirements of Internet users and protect users’ data as a part of the new law.
According to Schatz’s statement, people have the expectations that their personal data that they give to apps or websites is well protected and will not be mishandled. The same way as lawyers and doctors are required to be responsible with the personal data they hold; as a result, there should be a law that confines online company in the same principle.
